1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of Atlas Finance (the “Service”), including atlasfinance.dev and related apps. By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Atlas Finance is a portfolio tracking and market information tool. Features may include portfolios, watchlists, quotes, charts, news, alerts, exports, and optional Atlas AI. Features may change or depend on third-party data.

3. Not Financial Advice

The Service is for informational and educational purposes only.

• Nothing constitutes investment, tax, legal, or other professional advice.
• Atlas AI output may be inaccurate, incomplete, or outdated.
• You alone are responsible for investment decisions and outcomes.
• Verify information independently and consult licensed advisors when needed.

4. Eligibility and Accounts

• You must be old enough to form a binding contract (and at least 13).
• Provide accurate registration information and keep credentials secure.
• You are responsible for activity under your account.
• We may suspend accounts that violate these Terms or pose security risks.

5. Acceptable Use

• No unlawful use or market manipulation
• No excessive scraping, abuse of APIs, or attempts to bypass security
• No malware or interference with the Service
• Do not present app or AI output as licensed financial advice
• No resale of the Service without written permission

6. Your Content

You retain ownership of portfolio data and notes you submit. You grant us a limited licence to host and process that content to operate the Service (including sync and AI features you use).

7. Market Data

Quotes, fundamentals, and news come from third parties and may be delayed or incorrect. We do not guarantee accuracy, completeness, or uptime of market data.

8. Fees and Subscriptions

Atlas Finance offers a free tier (portfolio, watchlists, quotes, limited Atlas AI) and an optional Atlas Pro subscription for Analysis suite, earnings depth, higher AI limits, PDF/realized P&L export, and multi-list extras. Pricing is shown on the Pricing page before purchase via Stripe Checkout. Subscriptions renew until canceled through the Stripe Customer Portal. Cancellation typically ends access at period end. Except where required by law, fees are non-refundable once a billing period has started.

9. Intellectual Property

The Service, branding, and software are owned by Atlas Finance or its licensors. You receive only a limited right to use the Service under these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR ACCURATE DATA.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS FINANCE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING FROM USE OF THE SERVICE OR RELIANCE ON ANY INFORMATION OR AI OUTPUT. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS OR USD 50.

12. Indemnity

You agree to indemnify Atlas Finance against claims arising from your misuse of the Service, your content, or violation of these Terms or law.

13. Termination

You may stop using the Service and delete your account in Settings. We may suspend or terminate access for breaches, legal reasons, or if we discontinue the Service. Surviving provisions include disclaimers and liability limits.

14. Changes

We may modify the Service. When we update these Terms or our Privacy Policy, we will bump the policy version and require you to review and accept the updated documents in the app before continuing. You will be notified in the app and must accept before access is restored.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules, subject to mandatory consumer protections where you live. South African courts have exclusive jurisdiction subject to such rights.
